Could face up to seven years if convicted in soda theft

DOVER - A Lebanon man could spend up to seven years in state prison after police say he stole a Mountain Dew from a Rochester convenience store earlier this year.

Charles Libby, 38, of Blaisdell Corner Road, was indicted on a felony charge of willful concealment earlier this month since court records show he's been twice convicted in the past for similar crimes.

According to the indictment, Libby stole a Mountain Dew from a Rochester Cumberland Farms convenience store on Jan. 13.

If convicted Libby faces a three and a half to seven year prison stretch and up to a $4,000 fine.

The Strafford County grand jury indictments were handed down July 14 and released on Wednesday.

An indictment is not an indication of guilt, only that enough evidence has been gathered to warrant a trial.
